Terms of Service

1. Acceptance of Agreement

Welcome to EnjoyChinese ("the App" or "the Service"). This User Agreement ("the Agreement") is a legal agreement between you ("User" or "you") and the EnjoyChinese development team ("we" or "us") regarding the use of the EnjoyChinese mobile application and related services.

By downloading, installing, registering, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by all terms of this Agreement. If you do not agree to any provision of this Agreement, please do not install or use the App.

2. Service Description

EnjoyChinese is a mobile learning application for Chinese learners worldwide, providing the following core services:

• HSK (Chinese Proficiency Test) standard courses covering the complete Level 1-6 system
• Graded reading materials covering Chinese culture, history, daily life, and other topics
• AI pronunciation assessment and practice features
• Chinese character games and interactive learning modules
• Learning progress tracking and data statistics
• User feedback and customer support

We reserve the right to modify, suspend, or discontinue part or all of the Service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration and Security

3.1 Eligibility

You must be at least 13 years old to create an account and use the Service. If you are under 13, please use the Service under the supervision and consent of a parent or legal guardian.

3.2 Account Information

During registration, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you become aware of any unauthorized use of your account, please notify us immediately.

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate the terms of this Agreement at our sole discretion. You may also delete your account at any time through in-app settings or by contacting us.

4. User Conduct

When using the Service, you agree not to:

• Violate any applicable laws, regulations, or terms of this Agreement
• Upload, post, or transmit any illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers and networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service or other systems or networks
• Use any automated means (such as robots, crawlers, scripts) to access or collect content from the Service
• Reverse engineer, decompile, or disassemble the application
• Rent, lease, lend, sell, resell, sublicense, distribute, or transfer your rights in the Service
• Remove, modify, or obscure any proprietary notices in the application

5. Intellectual Property

5.1 Our Intellectual Property

The App and all its content, features, designs, text, graphics, images, videos, audio, software code, and trademarks (collectively "Content") are the proprietary property of us or our licensors, protected by Chinese and international copyright, trademark, and other intellectual property laws.

5.2 User Content

You retain ownership of content you create, upload, or post in the App. By submitting content, you grant us a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing and improving the Service.

5.3 License

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on mobile devices you own or control, solely for your personal, non-commercial use.

6. Paid Services

6.1 Subscription Services

The App offers free and paid subscription services. Paid subscription features include but are not limited to: full course access, advanced learning features, personalized learning reports, etc. Specific paid content is subject to the in-app display. Subscription fees are charged to your app store account (Apple App Store or Google Play Store) upon purchase confirmation.

6.2 Auto-Renewal

Paid subscriptions will automatically renew before the end of the current period unless you cancel auto-renewal at least 24 hours before the current period ends. The renewal fee will be charged to your account within 24 hours before the current period ends. You can manage or cancel your subscription at any time through your device settings: iOS users go to Settings > Apple ID > Subscriptions; Android users go to Google Play Store > Account > Subscriptions. After cancellation, your subscription will remain active until the end of the current billing period and will not be renewed.

6.3 Refund Policy

All purchases are managed by the Apple App Store and Google Play Store. Refund requests must be submitted directly to Apple or Google in accordance with their respective refund policies. We are unable to process refunds directly. If you encounter technical issues with the service, please contact us at [email protected] and we will do our best to resolve your concerns.

7. Third-Party Services

The App may contain links to third-party websites, applications, or services. These third-party services are not under our control, and we are not responsible for the content, privacy policies, or practices of any third-party services. You use third-party services at your own risk and should read the relevant third-party terms of service and privacy policies.

8. Disclaimer

The Service is provided on an "as is" basis, without any express or implied warranties. To the fullest extent permitted by applicable law, we expressly disclaim all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, secure, or available at any particular time
• Any errors or defects in the Service will be corrected
• The Service or content obtained through the Service will meet your expectations or requirements
• The Service is free of viruses or other harmful components

9. Limitation of Liability

To the fullest extent permitted by applicable law, we and our affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of profits, data, goodwill, or other intangible losses) arising out of or related to this Agreement or the use of the Service.

Our total liability for any claim shall not exceed the amount you paid us for the use of the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless EnjoyChinese and its affiliates, officers, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of any provision of this Agreement
• Your use of the Service
• Your infringement of any third-party rights, including intellectual property and privacy rights

11. Termination

This Agreement remains in effect until terminated by you or us. You may terminate this Agreement at any time by deleting the App and ceasing use of the Service. We may immediately terminate or suspend your account and access to the Service in the following circumstances:

• Your violation of any provision of this Agreement
• Legal or regulatory requirements
• We decide to discontinue providing the Service

Upon termination, your right to use the Service shall immediately cease. Provisions of this Agreement that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitations of liability, and indemnification provisions) shall continue in effect.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the People's Republic of China, without regard to its conflict of law principles. Any dispute arising from or related to this Agreement shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party may submit the dispute to the competent people's court for resolution.

14. General Provisions

Entire Agreement:This Agreement constitutes the entire agreement between you and us regarding the use of the Service and supersedes any prior oral or written agreements.

Severability:If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Agreement shall continue in full force and effect.

No Waiver:Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

Assignment:You may not assign your rights or obligations under this Agreement without our prior written consent. We may freely assign this Agreement without restriction.
